Welcome to MTGCardsBuy.com (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of the MTGCardsBuy.com website, services, and related applications (“Platform”). By using the Platform, you agree to these Terms.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction. By using the Platform, you represent and warrant that you meet this requirement.

2. Account Registration

You must create an account to buy or sell items on the Platform. You agree to provide accurate, complete, and updated information. You are responsible for all activities under your account.

3. Role of MTGCardsBuy.com

We provide a digital marketplace for users to buy and sell Magic: The Gathering (“MTG”) cards and related products. We are not a party to any transaction between buyers and sellers. We do not inspect, store, verify, or guarantee any products listed on the site.

4. Buyer-Seller Transactions

All transactions conducted through MTGCardsBuy.com are solely between the buyer and the seller of the item. MTGCardsBuy.com does not own, sell, inspect, or possess the items listed on the platform and is not liable for the outcome of these transactions.

Accordingly:

  • We make no warranties regarding the quality, legality, or authenticity of any item listed.

  • We are not responsible for lost shipments, counterfeit products, miscommunication, or any other issue between buyers and sellers.

However, in certain circumstances where disputes arise (e.g., item not received, counterfeit goods, misrepresentation, or fraud), MTGCardsBuy.com reserves the right, but not the obligation, to step in as a neutral arbitrator.

Platform Dispute Arbitration

If MTGCardsBuy.com chooses to intervene in a dispute:

  • Our team will collect relevant information from both parties and make a binding decision on the matter.

  • This decision may include, but is not limited to, forcing a refund, partial refund, denial of claim, or account suspension.

  • Both buyer and seller agree in advance to accept and abide by any decision made by MTGCardsBuy.com in such disputes.

  • MTGCardsBuy.com’s determination shall be considered final and non-appealable within the scope of the platform.

We may also restrict access, withhold payouts, or reverse transactions when we believe it is necessary to prevent fraud or protect the integrity of the marketplace.

5. Seller Requirements

All sellers must:

  • Accurately describe products.

  • Accurately provide policies relevant.

  • Ship items within at most 5 business days, and securely.

  • Offer returns for at least 7 days.

  • Uphold all policies in force at time order was placed.

  • Only list authentic Magic: The Gathering cards and merchandise.

  • Not list or offer counterfeit, fraudulent, proxy, fake, or unauthorized cards.

  • Make good faith effort to resolve any disputes that arise with buyers.

  • Comply with all applicable laws.

Violation of this section may result in account suspension or termination.

6. Buyer Requirements

All buyers must:

  • Provide a valid and complete shipping address.

  • Pay promptly using accepted payment methods.

  • Not file false claims or initiate chargebacks without valid cause.

  • Use the platform in good faith.

  • Report any issues within 48 hours of delivery.

Buyers who violate these terms may have their accounts suspended or banned.

7. Law Enforcement & Illegal Activity

We reserve the right to report any illegal activity (e.g., fraud, counterfeit sales, money laundering) to authorities and cooperate fully with investigations. We may disclose user data at our discretion.

8. Fees and Payments

You agree to all applicable fees, disclosed prior to transaction or payout. We may withhold fees for violations or to resolve disputes.

9. User Content and License

You grant MTGCardsBuy.com a perpetual, worldwide, royalty-free license to use, reproduce, and distribute any content or data you submit. This includes listings, images, and metadata.

10. Data Collection and Usage

By using the Platform, you agree we may collect and use your data—personal, transactional, and behavioral—for any purpose, including analytics, marketing, or resale to third parties.

11. Prohibited Activities

You may not:

  • Sell counterfeit or proxy cards

  • Buy or sell using stolen info

  • Abuse or harass other users

  • Violate any law while using the site

  • Attempt to circumvent fees or manipulate the system

12. Account Suspension or Termination

We may suspend or terminate your account at any time for violation of these Terms or if we suspect fraud, abuse, or illegal activity.

We may (a) suspend, limit, or terminate your account, (b) place temporary or permanent holds on payouts, or (c) initiate a Platform Arbitration (as defined in § 4) at any time for violations of these Terms, suspected fraud, or user disputes.
When Platform Arbitration is invoked:

  1. Co-operation Obligation. Both parties must promptly supply any evidence we request (e.g., photos, tracking numbers, transaction receipts).

  2. Binding Effect. Our written decision is final and not subject to appeal within the Platform. Users waive any claim against MTGCardsBuy.com arising from or relating to our arbitration process or outcome.

  3. Enforcement Mechanisms. You expressly authorize us to charge your payment method, reverse transfers, apply credits, or instruct third-party processors to execute our ruling. Failure to comply may result in permanent ban and referral to collections or law enforcement.

13. Disclaimers

The Platform is provided “AS IS.” We make no guarantees regarding the accuracy, reliability, or outcome of any transaction on the site.

14. Limitation of Liability

To the maximum extent allowed by law:

  • MTGCardsBuy.com is not liable for any direct, indirect, incidental, or consequential damages.

  • Our liability, if any, is limited to $100 or the amount paid to us in the last 6 months, whichever is less.

15. Indemnity

You agree to indemnify and hold harmless MTGCardsBuy.com and its affiliates from any claim, dispute, damage, or liability resulting from your use of the platform or violation of these Terms.

16. Changes to Terms

We may modify these Terms at any time. Continued use of the site constitutes agreement to the revised Terms.

17. Governing Law

These Terms are governed by the laws of the State of Colorado. Disputes shall be resolved in the courts of Araphoe County.

18. Third-Party Links and Affiliate Content
The Platform may contain links to third-party websites, services, or content, including affiliate links that may earn MTGCardsBuy.com a commission. These links are provided for your convenience only. We do not control, endorse, or assume responsibility for any third-party sites or services.

By using these links, you acknowledge and agree that:

  • MTGCardsBuy.com makes no representations or warranties about the accuracy, legality, security, or quality of third-party content or services.

  • We are not liable for any damages or losses arising from your access to or use of third-party websites or transactions made through them.

  • You assume all risk associated with visiting or engaging with third-party content.

It is your responsibility to review the terms and policies of any third-party site before using their services or providing them with any personal information.
